WINDEWARD BOUND BRIGANTINE AND THE WINDEWARD BOUND TRUST 

CONDITIONS OF CARRIAGE AND CHARTER 

  • The Windeward Bound Trust warrants that the Brigantine Windeward Bound, (or any other vessel used to fulfil this charter) will be in appropriate maritime survey to meet the needs of the voyage, and she will be operated within the limits of that survey and the vessel’s Standing Orders, Codes of Conduct, and Safety Management System, at all times.

  • The Windeward Bound Trust warrants that the Windeward Bound is fully insured and carries Public Liability insurance in the amount of USD$500,000,000 per incident. A Certificate of Currency is available on request.

  •  The Windeward Bound Trust also warrants that the crew of the Windeward Bound (or any other vessel used to fulfil this charter) will be manned by a competent and qualified crew in accordance with the manning requirements of the vessels survey, and the requirements of this particular voyage.

  •  A 30% deposit is required to secure your booking, an invoice will be rendered for the deposit and payment of the deposit is due on receipt by you of this invoice. 

  • The balance of your Charter Fee is due and payable to the Windeward bound Trust 30 days prior to the embarkation date, or if the booking is made within 30 days of the embarkation date, forthwith. An invoice for this balance will also be rendered. All invoices will be delivered by email, payment is to be made via the methods described in the invoice. 

  • The voyage will be conducted under the control of, and at the discretion of, the Master, who will retain total authority over the ship and the ship’s company (Ships company describes and includes all persons carried on board whether officers, crew, paying passengers, sail trainees students, school or charterer’s staff  or supernumeraries) and will have the sole discretion to alter all or any part of the voyage in the interests of the safety of the ship, or the ships company, at any time during the voyage. While the objectives of the voyage remain paramount, they will not take precedence over the aforesaid safety. Within reason, all such decisions will include discussions of options with the charterer’s representative on board. 

  • No extra charge to the charter fee will be made if the voyage completion or return is delayed by weather and the Master will make every effort within the limits of safety to complete the voyage at the designated port of completion. Should the charterer, or their representative on board decide to cancel or otherwise end the voyage because of such a delay, it will be the Master’s decision whether charter passengers can be landed safely and the transport costs of returning participating passengers to the port of choice will be the responsibility of the charterer, and no refund of charter fees will apply. 

  • The voyage will begin as designated, however if the voyage or the departure is delayed by weather, issues of safety, or other reasons beyond the control of the Master, the voyage will re-commence as soon as the Master is satisfied that it is safe to do so. Any necessary changes to the voyage objectives caused by the delay will be made following discussions between the Master and ship’s officers and the Charterer’s designated representative (s) on board.  

  • The charterer will not encourage, sanction or participate in the bringing on board of alcohol, tobacco or prohibited drugs, or their use on board the vessel. Discovery of such substances on board may result in the offending participant being removed from the ship and sent home. The ship may, if deemed necessary, divert to the nearest port to facilitate such action. Any costs associated with returning the offending participant will be borne by the charterer.

  • The charterer will ensure that all participants complete a Windeward Bound Medical questionnaire signed by their family doctor, and, if under 18 years of age, one of their parents or guardian. These completed medical forms will be forwarded to the Trust 14 days prior to the voyage. 

  • Cancellation policy: - 

  • If the voyage is cancelled by the Windeward Bound Trust due to the inability of the Windeward Bound to sail, or the inability to provide a suitable replacement vessel then the voyage fees paid thus far will be refunded in full.

  • If the voyage is delayed, but not cancelled, by the Windeward Bound Trust, due to weather or other outside circumstances beyond the control of the Windeward Bound Trust, then the voyage will be conducted as previously stated and no refund will apply.

  • If the voyage is cancelled by the Charterer within 90 days and 45 days of the sailing date, fees paid are refunded in full less any voyage costs already paid out. If any voyage costs have already been paid out, and cannot be redeemed, a full accounting of these costs will be made to the charterer.If the voyage is cancelled by the Charterer between 45 days and 21 days of the sailing date, the deposit is retained but any other fees paid above the deposit will be refunded.

  • If the voyage is cancelled by the Charterer 21 days or less from the voyage date no refund of any fees is made.
